This article considers an international sample of venture capital and private equity funds to assess the role of law, corruption, and culture in setting fund manager fees. With better legal conditions, fixed fees are lower, carried interest fees are higher, clawbacks are less likely, and share distributions are more likely. Countries with lower levels of corruption have lower fixed fees and higher performance fees, and are less likely to have clawbacks and cash-only distributions. Hofstede's measure of power distance is negatively (...) related to fixed fees and the use of cash-only distributions, but positively related to performance fees and clawbacks. Overall, the data strongly indicate that corruption, culture, and legal settings are much more significant in determining fees than fund manager characteristics and/or market conditions. (shrink)

Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer-reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

It has been argued that in a deterministic universe, no one has any reason to do anything. Since we ought to do what we have most reason to do, no one ought to do anything either. Firstly, it is argued that an agent cannot have reason to do anything unless she can do otherwise; secondly, that the relevant ‘can’ is incompatibilist. In this paper, I argue that even if the first step of the argument for reason incompatibilism succeeds, the second (...) one does not. It is argued that reasons require alternative possibilities, because reasons are action-guiding. A supposed reason to do the impossible, or to do what was inevitable anyway, could not fill this function. I discuss different interpretations of the claim that reasons are action-guiding, and show that according to one interpretation it is sufficient that the agent believes that she has several alternative options. According to other interpretations, the agent must really have alternative options, but only in a compatibilist sense. I suggest that an interpretation of action-guidance according to which reasons can only guide actions when we have several options open to us in an incompatibilist sense cannot be found. We should therefore assume that reasons and obligations are compatible with determinism. (shrink)

The article constitutes a detailed overview of the most important background literature on the topic of scientific representation. It gives a detailed outline of many of the important philosophical accounts of scientific representation. The primary division is between substantive accounts and deflationary/pragmatic accounts. Objections to each type of account are considered. Insights from the literature on modelling are discussed along with an overview of some of the insights from the sociology of science.

It is widely argued that the skills of scientific expertise are tacit, meaning that they are difficult to study. In this essay, I draw on work from the philosophy of action about the nature of skills to show that there is another access point for the study of skills—namely, skill transmission in science education. I will begin by outlining Small’s Aristotelian account of skills, including a brief exposition of its advantages over alternative accounts of skills. He argues that skills exist (...) in a sort of life cycle between learning, practicing, and transmitting, which provides reasons to think that we should pay close attention to the way skills are transmitted in teaching and learning. To demonstrate how a study of skill transmittance can be revealing about the nature of skills in expertise, I explore an example—what I identify as the skill of tension-balancing in model-building. After describing the skill, I briefly examine two case studies from the science education literature that reveal insights about the skill of tension-balancing as it functions in the practice of model-building. In this essay, I examine the role of dissimilarity in scientific representation. After briefly reviewing some of the philosophical literature which places a strong emphasis on the role of similarity, I turn to examine some work from Carroll and Borges which demonstrates that perfect similarity is not valuable in the representational use of maps. Expanding on this insight, I go on to argue that this shows that dissimilarity is an important part of the representational use of maps—a point I then (...) extend to the case of scientific representation. Relying on some work from Latour, I argue that dissimilarity plays an essential role in representational practice, by providing novel forms of manipulation and use which affords the achievement of various epistemic and nonepistemic aims. After showing how this point connects to some other literature on scientific representation, I discuss some examples of the value of dissimilarity in the use of representational vehicles. Overall, I argue that to understand scientific representation, we will need to consider more than just similarity. We will need to explore dissimilarities as well. (shrink)

Proof requires a dialogue between agents to clarify obscure inference steps, fill gaps, or reveal implicit assumptions in a purported proof. Hence, argumentation is an integral component of the discovery process for mathematical proofs. This work presents how argumentation theories can be applied to describe specific informal features in the development of proof-events. The concept of proof-event was coined by Goguen who described mathematical proof as a public social event that takes place in space and time. This new meta-methodological concept (...) is designed to cover not only “traditional” formal proofs but all kinds of proofs and inference steps, including incomplete or purported proofs. Our approach attempts to make proof-events more comprehensive to express the complete trajectory of a mathematical proof-event until the ultimate validation of the proving outcome. Thus, we advance an extended version of proof-event calculus which is built on argumentation theories designed to capture the internal and external structure of collaborative mathematical practice and highlight the relationship between proof, human reasoning, and cognitive processes. In addition, another area in which argumentation can make a significant contribution is dealing with the defeasible knowledge of the Web which is a product of its open and ubiquitous nature. This approach seems to be sufficient for the presentation of Web-based proving processes as manifested in the case of the Mini-Polymath 4 project. (shrink)

This study examines the ethical dilemmas and difficulties encountered by Portuguese school psychologists. As part of a larger survey, participants were asked about ethical issues faced in daily practice and asked to describe ethical incidents. Of the 477 respondents, 274 reported 441 ethically troubling or challenging situations. Responses were coded into a six-category system based on the code of ethics of Portuguese psychologists. Most of the reported dilemmas concerned privacy and confidentiality principles. Results are discussed in light of relevant literature (...) and international findings. While many recent accounts of scientific representation have given a central role to the agency and intentions of scientists in explaining representation, they have left these agential concepts unanalyzed. An account of scientific, representational actions will be a useful piece in offering a more complete account of the practice of representation in science. Drawing on an Anscombean approach to the nature of intentional actions, the Means-End Account of Scientific, Representational Actions describes three features of scientific, representational actions: the final description (...) in the means-end ordering of descriptions is some scientific aim; that interaction with a vehicle distinct from its target stands as an earlier description which is ordered toward the final description as means to end; and the means-end structure is licensed by scientific practice. After describing each of the components of the Means-End Account in greater detail through the example of the representational use of a mathematical model, I explain how it can demarcate scientific, representational actions from other sorts of actions. I close by describing some payoffs of the account, showing how it contributes to a more thorough understanding of the practice of representation in science and how it can be of use in understanding the close connection between representation and other forms of scientific activity. Aesthetic experience is original, dynamic and ever-changing. This article covers three research questions (RQs) concerning how immersive installation artworks can elicit emotions that may contribute to their popularity. Based on Yayoi Kusama’s and Peter Kogler’s kaleidoscopic rooms, this study aims to predict the emotions of visitors of immersive installation art based on their Twitter activity. As indicators, we employed the total number of likes, comments, retweets, followers, followings, the average of tweets per user, and emotional response. According to our evaluation (...) of emotions, panic obtained the highest scores. Furthermore, compared to traditional machine learning algorithms, Tree-based Pipeline Optimization Tool (TPOT) Automated Machine Learning used in this research yielded slightly lower performance. We forecast that our findings will stimulate future research in the fields of data analysis, cultural heritage management and marketing, aesthetics and cultural analytics. (shrink)

The health sector is facing many challenges, and there is a need to maintain the delivery of high‐quality health‐care. Issues related to equity and access to health‐care have emerged in a context of an economic recession in which the sustainability of the health system depends on everyone, including the actions and decisions of professionals. Therefore, nurses and their skills may be the answer to ethical, professional and community health management, but this recession could lead to major problems in the education (...) of nurses in daily health‐care practice. Due to the limited availability of resources, nurses are increasingly taking leadership positions, continuing to develop their critical abilities and thinking skills, and considering sciences such as deontology and ethics. The main goals of this study were to reflect on the economic recession and its impact on health‐care and to demonstrate the contribution of nursing to the sustainability of health‐care and in the promotion of individuals' dignity. The authors conclude that health‐care depends on economic redistribution and, in this context, needs to be equitable and fair. Nurses have the responsibility to develop their profession according to the underlying sciences and can therefore strategically help the healthcare system. (shrink)

In times of unprecedented ecological change led by human activities, a global ethical framework is most needed to support the rapid transformation of current development models, to ensure the protection of human and non-human nature. Geoethics offers such a universal system of values. We assess to what extent geoethics maintains an anthropocentric perspective and examine the ethical challenges raised by this statement, arguing that (i) geoscientific knowledge, which investigates the interrelations between the biotic and abiotic world in a deep-time perspective, (...) should imply the adoption of an eco-centric or even geocentric perspective; (ii) the assumption of an anthropocentric perspective should be outlined more precisely, by clarifying the utilitarian and deontological reasons to maintain a weak anthropocentric approach and to avoid the theoretical bias underlying many anthropocentric narratives. Then, we claim that a non-anthropocentric geoethics would allow a better understanding of the role Homo sapiens as a species plays within the biosphere and geosphere. To provide evidence for our hypothesis, we will discuss two case studies: (i) climate change as a monumental niche construction process, where the ambivalence of human nature is seen in action; (ii) the co-evolution and interconnection between biological and cultural diversity, which support each other in an inextricable link. We claim that a humanistic, eco-centric geoethics can support the necessary transition towards a new conceptual framework in which humans are not separate from, but part of the biosphere. This approach is part of the philosophy of biology, a field that programmatically converges humanities and the life sciences. (shrink)

In 2000 “Literatura e Utopia”, a research group led by Ildney Cavalcanti, started working at the Federal University of Alagoas, including members from three other institutions. Despite its namesake, the group focuses extensively on cultural as well as literary aspects of utopian thinking, with special regard for the colonial and postcolonial viewpoints of Latin America. Previously, I (Boesch 2017) described a notion called “representational licensing”—the set of activities of scientific practice by which scientists establish the intended representational use of a vehicle. In this essay, I expand and develop this concept of representational licensing. I begin by showing how the concept is of value for both pragmatic and substantive approaches to scientific representation. Then, through the examination of a case study of the Mississippi River Basin Model, I point out and explain some of the (...) activities of representational licensing that help to establish the representational nature of this model. Throughout the exploration of the case study, I pause to identify some important lessons which apply more generally about the nature of representational licensing in science. (shrink)

Addressing a gap in political thought, this book examines the interplay between ethos and practical reason in everyday life. The First Great Political Realist is a succinct and penetrating analysis of one of the ancient world's foremost political realists, Kautilya. Kautilya's treatise Arthashastra stands as one of the great political books of the ancient world, its ideas on the science of politics strikingly similar to those of Thucydides, Machiavelli, Hobbes, Clausewitz, and even Sun Tsu. Roger Boesche's excellent commentary on Kautilya's voluminous text draws out the essential realist arguments for modern political analysis and demonstrates the continued relevance of Kautilya's (...) work to modern Indian strategic thinking and our understanding of the relationship between politics and economics. All known chimpanzee populations have been observed to hunt small mammals for meat. Detailed observations have shown, however, that hunting strategies differ considerably between populations, with some merely collecting prey that happens to pass by while others hunt in coordinated groups to chase fast-moving prey. Of all known populations, Taï chimpanzees exhibit the highest level of cooperation when hunting. Some of the group hunting roles require elaborate coordination with other hunters as well as precise anticipation of the movements of the (...) prey. The meat-sharing rules observed in this community guarantee the largest share of the meat to hunters who perform the most important roles leading to a capture. The learning time of such hunting roles is sometimes especially long. Taï chimpanzee males begin hunting monkeys at about age 10. The hunters’ progress in learning the more sophisticated hunting roles is clearly correlated with age; only after 20 years of practice are they able to perform them reliably. This lengthy learning period has also been shown in some hunter-gatherer societies and confirms the special challenge that hunting represents. (shrink)

Philosophers traditionally distinguish between excuses and exemptions. We can excuse someone and still see them as a participant in normal human relationships, but when we exempt someone, we see them as something to be managed and handled: we take an objective attitude to them. Madness is typically assumed to ground exemptions, not excuses. So far, the standard philosophical picture. Seeing other people as objects to be managed and handled rather than as persons with whom one can have relationships is, however, (...) ethically problematic. If I am mad myself, consistently seeing myself this way becomes downright unsustainable. A better option, I will argue, is to fully appreciate my own difficulties and learn to show myself compassion and understanding. I, then, can excuse myself on those grounds. Furthermore, a compassionate self-excusing attitude leaves room for both nuance and improvement in a way that total exemption does not. Finally, I will argue that many mad actions ought to be considered justifiable and justified rather than in need of exemption or excuse. (shrink)

This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

The quest to understand has been heading towards an impasse, when comparative psychology compares primarily individuals that are not representative of their species. Captives experience such divergent socioecological niches that they cannot stand for their wild counterparts. Only after removing ethnocentrism and anthropocentrism will we be able to progress in our understanding of.

We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. Callender and Cohen argue that there is no need for a special account of the constitution of scientific representation. I argue that scientific representation is communal and therefore deeply tied to the practice in which it is embedded. The communal nature is accounted for by licensing, the activities of scientific practice by which scientists establish a representation. A case study of the Lotka-Volterra model reveals how licensure is a constitutive element of the representational relationship. Thus, any account of the constitution (...) of scientific representation must account for licensing, meaning that there is a special problem of scientific representation. (shrink)

In this paper, I will argue for two interrelated theses. First, if we take phenomenological psychopathology seriously, and want to understand what it is like to undergo various psychopathological experiences, we cannot treat madpeople’s testimony as mere data for sane clinicians, philosophers, and other scholars to analyze and interpret. Madpeople must be involved with analysis an interpretation too. Second, sane clinicians and scholars must open their minds to the possibility that there may be experiences that other people have, which they (...) nevertheless cannot conceive of. I look at influential texts in which philosophers attempt to analyze and understand depersonalization and thought insertion. They go astray because they keep using their own powers of conceivability as a guide to what is or is not humanly possible to experience. Several experiences labeled inconceivable and therefore impossible by these philosophers, are experiences I have had myself. Philosophers and others would be less likely to make this mistake if they would converse and collaborate more with the madpeople concerned. When this is not feasible, they should nevertheless strive to keep an open mind. Fantastical fiction may have a role to play here, by showing how bizarre experiences may nevertheless be prima facie conceivable. (shrink)

Ignoring most published evidence on wild chimpanzees, Tomasello et al.'s claim that shared goals and intentions are uniquely human amounts to a faith statement. A brief survey of chimpanzee hunting tactics shows that group hunts are compatible with a shared goals and intentions hypothesis. The disdain of observational data in experimental psychology leads some to ignore the reality of animal cognitive achievements.

Increased work complexity and financial strain in the health care sector have led to higher demands on staff to handle ethical issues. These demands can elicit stress reactions, that is, moral distress. One way to support professionals in handling ethical dilemmas is education and training in ethics. This article reports on a controlled prospective study evaluating a structured education and training program in ethics concerning its effects on moral distress. The results show that the participants were positive about the training (...) program. Moral distress did not change significantly. This could be interpreted as competence development, with no effects on moral distress. Alternatively, the result could be attributed to shortcomings of the training program, or that it was too short, or it could be due to the evaluation instrument used. Organizational factors such as management involvement are also crucial. There is a need to design and evaluate ethics competence programs concerning their efficacy. (shrink)

Harming other people is prima facie wrong. Unless we can be very certain that doing so is justified under the circumstances, we ought not to do it. In this paper, I argue that we ought to dismantle harsh retributivist criminal justice systems for this reason; we cannot be sufficiently certain that the harm is justified. Gregg Caruso, Ben Vilhauer and others have previously argued for the same conclusion; however, my own version sidesteps certain controversial premises of theirs. Harsh retributivist criminal (...) justice can only be morally right if the following three propositions are true: Moral responsibility exists, retributivism is right, and we can find out how much punishment offenders deserve for their crimes. Suppose that we initially assign a high credence to each of the three propositions; I assume for the sake of argument that there are good arguments in support of each. Nevertheless, these arguments ultimately depend on intuitions. Since we have philosophical peers whose intuitions differ from ours, we ought to downgrade our credence in each. However, even slightly less credence in each proposition means far less credence in a conjunction of all three. Since the stakes are high and there are morally safer options for a criminal justice system, we ought to dismantle harsh retributivist ones. (shrink)

This book explores a little-noticed tradition in the history of European political thought. From Plato to Aristotle to Tacitus and Machiavelli, and from Tocqueville to Max Weber and Hannah Arendt, political thinkers have examined the tyrannies of their times and have wondered how these tyrannies come about, how they work, and how they might be defeated. In examining this perennial problem of tyranny, Roger Boesche looks at how these thinkers borrowed from the past—thus entering into an established dialogue—to analyze the (...) present. Although obviously tyrannies are not identical over time, we can learn partial lessons from past thinkers that can help us to better understand twentieth-century tyrannies. (shrink)

Following the tradition of comparing humans with chimpanzees placed under unfavorable conditions, the authors suggest many uniquely human technological abilities. However, chimpanzees use spontaneously tools in nature to achieve many different goals demonstrating technological skills and reasoning contradicting the authors contrast. Chimpanzees and humans develop skills through the experiences faced during their upbringing and neglecting this leads to fake conclusions.

This paper defends the use of quasi-experiments for causal estimation in economics against the widespread objection that quasi-experimental estimates lack external validity. The defence is that quasi-experimental replication of estimates can yield defeasible evidence for external validity. The paper then develops a different objection. The stable unit treatment value assumption, on which quasi-experiments rely, is argued to be implausible due to the influence of social interaction effects on economic outcomes. A more plausible stable marginal unit treatment value assumption is proposed, (...) but it is demonstrated to severely limit the usefulness of quasi-experiments for economic policy evaluation.
